Safety and Risk Policy
Annex to the Terms and Conditions, Users Section and Professionals Section, and referred to in them. In the event of a conflict between this Policy and the Terms, the Terms prevail. ToBePolo may update it, with effect for listings published after the update, by giving notice on the Platform.
1. Purpose and role of ToBePolo
This Policy sets out how Crafts and Experiences are classified by risk level, which categories are not permitted and which requirements the Professional must meet for each level. Its purpose is to allow ToBePolo to select and filter access to the Platform, without thereby taking on any role as organiser, guarantor or supervisor of the Crafts and Experiences.
Core principle. ToBePolo sets access requirements and checks that the required declarations and documents exist; it does not assess how the Craft or Experience is carried out and does not guarantee safety, quality or the adequacy of insurance cover. Responsibility for carrying it out safely remains with the Professional.
Terminology. Consistently with the Terms, this Policy divides providers into Professionals with a VAT number and Private Individuals without a VAT number — those who offer Crafts and Experiences based on personal, traditional or family skills without a VAT number, on an occasional basis.
2. Risk levels
Each Craft or Experience is classified in one of the following three levels. The classification is declared by the Professional when publishing, according to the criteria set out here. Where a Craft or Experience has features belonging to more than one level, the highest level applies.
| Level | Features | Indicative examples |
|---|---|---|
| Low | Manual, educational or demonstrative Crafts and Experiences without the use of significant sources of danger; no significant cutting or piercing tools, no source of heat or flame, no chemical risk, no intense physical activity. | Crochet, knitting, embroidery, drawing, painting on paper, decoration, creative writing, non-alcoholic tastings, basic photography. |
| Medium | Crafts and Experiences with cutting tools or work tools, moderate heat sources, materials requiring care, or light physical effort, manageable with normal precautions. | Pottery on the wheel, light woodworking, cooking with knives and hobs, sewing with machines, small-scale goldsmithing, activities with docile animals. |
| High | Crafts and Experiences with open flames, high temperatures, large blades or power tools, hazardous substances, or a significant physical or environmental component. | Working hot glass and metal, forging, foundry work, glassblowing, knife-making, chainsaw work, climbing, water activities. |
The examples are purely indicative: what determines the level are the actual features of the Craft or Experience — tools, sources of danger, setting, physical effort — not the name of the craft.
3. Requirements by risk level
Low risk. No mandatory insurance requirement. Open both to Professionals with a VAT number and to Private Individuals without a VAT number. The only risk level open to minors, with a parent’s written consent, under the Terms for Users.
Medium risk. Reserved for Professionals with a VAT number. A civil liability insurance policy suitable for covering damage to persons and property connected with the Craft or Experience is mandatory; its details must be declared when publishing. Additional documentation, such as certificates or qualifications, may be requested depending on the category.
High risk. Reserved for Professionals with a VAT number. The civil liability insurance policy described above is mandatory; ToBePolo may request specific additional documentation — certifications, suitability of premises and equipment as declared by the Professional, any sector qualifications. Minors are not admitted.
In all cases ToBePolo checks that the declaration, the policy details and the documentation exist, but does not certify their adequacy, validity or sufficiency.
4. Prohibited Crafts and Experiences
The following categories are not permitted on the Platform during the launch phase. The list may be extended or reduced in future updates and illustrates the exclusion criteria: ToBePolo may exclude further Crafts and Experiences that present similar risks or require authorisations the Professional does not hold.
| Prohibited category | Reason |
|---|---|
| Crafts and Experiences requiring licences, qualifications or health authorisations that cannot be verified on the platform — for example serving food and drink with professional preparation, invasive beauty treatments, healthcare or paramedical activities. | Strict sector regulation; risk of unlawful practice of a profession. |
| Crafts and Experiences in which serving or tasting alcoholic drinks is a central element. | Rules on licences and the sale of alcohol; protection of minors. |
| Crafts and Experiences involving firearms, weapons, explosives or pyrotechnic materials. | Public security legislation; high risk that cannot be insured in the ordinary way. |
| Underwater activities, parachuting, flying, diving and extreme sports with a high risk to life. | Risk to life; specialist authorisation and insurance framework. |
| Crafts and Experiences with sexual content or otherwise unsuitable for minors. | Protection of minors and public order. |
| Activities in which participants drive motor vehicles on roads or tracks. | Insurance and liability aspects that the Platform cannot manage during the launch phase. |
5. Incorrect classification and power to block
Where ToBePolo finds that the classification of a Craft or Experience is inconsistent with the criteria of this Policy, or that the Professional does not meet the requirements declared for the stated level, ToBePolo does not reclassify the Craft or Experience itself: it suspends or does not publish the listing and asks the Professional to correct or complete it, giving reasons. Publication resumes once the classification has been corrected or the requirements provided.
This approach means that ToBePolo does not express its own safety judgement on the Craft or Experience, and keeps its role as an intermediary.
6. Minors
Minors may take part only in low-risk Crafts and Experiences, with the prior written consent of a parent or of the person exercising parental responsibility. Medium- and high-risk Crafts and Experiences are not open to minors. The Professional may set stricter age limits for their own Craft or Experience.
7. Threshold for moving from occasional to professional activity
A Private Individual without a VAT number may operate within the limits of occasional activity. For each Private Individual, ToBePolo monitors the total value of the consideration accrued on the Platform and the number of Crafts and Experiences provided in the calendar year. When either of the following two thresholds is reached, whichever comes first, ToBePolo sends a notice and makes the continuation of activity on the Platform conditional on acquiring the status of Professional with a VAT number:
- Amount threshold: €5,000 in total consideration in the calendar year.
- Number threshold: 50 Crafts and Experiences provided in the calendar year.
ToBePolo may in any case require the status of Professional with a VAT number to be acquired even before these thresholds are reached if, owing to frequency, continuity, organisation, promotion, available calendar, economic volume or manner of performance, the activity is no longer merely occasional.
8. Checks and documentation
Consistently with Article 30 of Regulation (EU) 2022/2065 (DSA) and with the Terms, ToBePolo collects, during onboarding and publication, the declarations and documents required for the category and risk level of the Craft or Experience, and may ask for them to be updated. The check concerns the existence and formal completeness of what has been declared; it does not constitute any certification of merit by ToBePolo.
